Terms of Service
The terms that govern use of our website, portals and communications. Interpreting services are governed by your signed service agreement.
Effective date: October 3, 2026
Last updated: October 3, 2026
These Terms of Service ("Terms") govern your access to and use of unspokenasl.com, our client and interpreter portals, our Knowledge Center, our forms and our related communications (together, the "Site"), provided by Unspoken Language Services, Inc. ("Unspoken", "ULS", "we", "us" or "our"). Please read them carefully. They include a binding arbitration agreement and a class action waiver in section 17, which affect how disputes are resolved.
By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you use the Site on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf, and "you" includes that organization. You must be at least 18 years old to use the Site. If you do not agree to these Terms, do not use the Site.
1. Our services and your service agreement
The Site describes our interpreting and related services and allows organizations to request them. Interpreting services are provided under a written service agreement between your organization and Unspoken, which sets out rates, minimums, cancellation terms, billing and other terms of service. If these Terms conflict with your service agreement, your service agreement controls for the services it covers. Nothing on the Site, including descriptions, statistics or examples, modifies a service agreement or by itself creates a contract for services.
2. Requests and confirmations
- Submitting a request through the Site, by email or by phone does not reserve an interpreter. A request is confirmed only when we confirm it to you in writing, and you should not rely on coverage until you receive our confirmation.
- Standard requests require at least 72 hours' notice. We accept requests with shorter notice as urgent requests, but we cannot guarantee that any request, urgent or otherwise, will be filled.
- Interpreter availability is not guaranteed until a request is confirmed. We may assign, substitute or add interpreters at our discretion to meet the needs of an assignment, including team interpreting for long or demanding assignments.
- You are responsible for the accuracy and completeness of the information you provide, including dates, times, locations, meeting links, the nature of the assignment and the communication needs of participants. Inaccurate or incomplete information may affect our ability to fulfill a request and may result in charges under your service agreement.
- You are responsible for providing a safe environment and the access, lighting, positioning and technology an interpreter reasonably needs to perform the assignment.
3. Interpreters
Every interpreting assignment is performed by a qualified human interpreter. Interpreters assigned through Unspoken may be our employees or independent contractors, and they are bound by the NAD-RID Code of Professional Conduct and our confidentiality requirements. An interpreter's role is to facilitate communication. Interpreters do not provide legal, medical, mental health, educational or other professional advice, do not act as advocates for any party, and are not responsible for the content of the communication they interpret or for decisions made by any participant.
4. No legal, medical or compliance advice
Information on the Site, including Knowledge Center articles, frequently asked questions and service descriptions, is general information drawn from our operational experience. It is not legal, medical or other professional advice, and it is not a determination of your obligations under the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, Section 1557 of the Affordable Care Act, the Individuals with Disabilities Education Act or any other law. Your organization remains solely responsible for determining and meeting its own legal and accessibility obligations and should consult its own counsel.
5. Emergencies
The Site, our email and our text messages are not monitored continuously and must not be used to report an emergency. In an emergency, call 911 or your local emergency number. For an urgent interpreter request, call us at 1-888-280-0751.
6. Accounts and portals
Access to the client and interpreter portals is limited to authorized users. You are responsible for keeping your login credentials confidential, for all activity under your account, and for telling us promptly of any unauthorized access. Client organizations are responsible for the users they authorize and for having access removed when a user leaves. We may suspend or terminate access to any account at any time, including to protect the security of the Site, our clients or the people we serve.
7. Interpreter applicants
Submitting an interpreter application does not create an employment, contractor or other relationship and does not guarantee onboarding or assignments. You represent that the information and documents you submit are accurate, complete and your own. You authorize us to verify your credentials, certifications, licenses and references with the issuing organizations and registries, including the Registry of Interpreters for the Deaf. Any background check is conducted only with your separate written authorization, as required by law. Any engagement is governed by a separate written agreement.
8. Communications and text messages
By providing your contact information, you consent to receive communications from us by email, phone and text message about your requests, assignments, account, applications and inquiries. You agree that agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that they be in writing.
Text messages. If you provide a mobile number, you agree to receive text messages from Unspoken about requests, assignments, scheduling and your account. Consent to receive text messages is not a condition of purchasing any service. Message frequency varies, and message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Mobile carriers are not liable for delayed or undelivered messages. Our handling of mobile information is described in our Privacy Policy.
9. Acceptable use
You agree not to:
- use the Site in violation of any law or regulation, or to infringe the rights of others;
- submit false, misleading or fraudulent information, impersonate any person or organization, or submit information about another person without authority to do so;
- access or attempt to access accounts, systems or data without authorization, or probe, scan or test the vulnerability of the Site;
- introduce viruses, malware or other harmful code, or interfere with the operation of the Site;
- scrape, crawl, harvest or collect content or information from the Site by automated means, or use Site content to train artificial intelligence or machine learning models, without our prior written consent;
- copy, frame, mirror, sell or republish Site content, except as these Terms permit;
- send spam, unsolicited advertising, or abusive, harassing, discriminatory or unlawful content through the Site; or
- use the Site to solicit or recruit our interpreters or staff on behalf of another business.
10. Content you submit
You are responsible for the content you submit through the Site, including comments, feedback, messages and uploaded documents ("Submissions"). You represent that you have the right to submit them and that they do not violate any law or the rights of others. You grant Unspoken a non-exclusive, worldwide, royalty-free license to use, store, reproduce and display Submissions as needed to operate the Site and provide our services and, for comments posted publicly, to publish them on the Site. We may use feedback and suggestions without restriction or obligation to you. Comments are moderated, and we may decline, shorten or remove any Submission at our discretion. Do not include confidential, health or other sensitive information in public comments.
11. Artificial intelligence
We may use artificial intelligence tools to support our staff and to answer questions in the interpreter portal, as described in our Privacy Policy. Answers from the portal assistant are informational, may contain errors, and do not modify any agreement, rate, assignment or policy, so please confirm anything important with our staff. AI is never used to perform interpreting.
12. Intellectual property
The Site and its content, including text, articles, graphics, photographs, video, logos, the names Unspoken Language Services, ULS and The Unspoken Promise, and the design and software of the Site, are owned by or licensed to Unspoken and are protected by copyright, trademark and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for its intended purposes, and to share links to and brief excerpts of Knowledge Center articles with attribution and a link to the original. Any other use, including reproducing, modifying, distributing or creating derivative works, requires our prior written consent. All rights not expressly granted are reserved.
Copyright concerns. If you believe content on the Site infringes your copyright, send a notice to contact@unspokenasl.com identifying the work, the material and its location on the Site, and your contact information, with a statement that you believe in good faith the use is not authorized and that your notice is accurate. We will review the notice and respond appropriately.
13. Third-party links and services
The Site may link to or embed third-party websites, videos and services, and our services may use video meeting platforms you choose. We do not control and are not responsible for third-party content, products, services or privacy practices. Your use of them is at your own risk and subject to their terms.
14. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. We do not warrant that the Site will be uninterrupted, secure or error-free, or that its content is complete or current. Statistics on the Site, such as fulfillment rates and hours of service, describe past performance and are not a guarantee of future results. Any warranties for interpreting services are only those stated in your service agreement.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UNSPOKEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, INTERPRETERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Liability relating to interpreting services is governed exclusively by your service agreement. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
16. Indemnification
You agree to defend, indemnify and hold harmless Unspoken and its officers, directors, employees, contractors, interpreters and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site, your Submissions, the information you provide, your violation of these Terms, or your violation of any law or the rights of another.
17. Dispute resolution
Informal resolution. Before starting any formal proceeding, you agree to send us a written description of the dispute at contact@unspokenasl.com and to try in good faith to resolve it with us for at least 30 days.
Binding arbitration. Except as stated below, any dispute, claim or controversy arising out of or relating to the Site or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association under its applicable rules, before a single arbitrator. The arbitration will take place in Los Angeles County, California, or by video conference if the parties agree, and will be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction. Where your organization has a service agreement with Unspoken, the dispute resolution terms of that agreement control for the disputes it covers.
Class action waiver. Disputes will be resolved only on an individual basis. You and Unspoken each waive any right to bring or take part in a class, collective, consolidated or representative action or arbitration.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court to protect its intellectual property, its confidential information or the security of the Site.
Opting out. You may opt out of this arbitration agreement by emailing contact@unspokenasl.com within 30 days after you first accept these Terms, stating your name and that you opt out of arbitration.
18. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules, and the arbitration agreement is governed by the Federal Arbitration Act. Subject to the arbitration agreement, any action arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
19. Changes to the Site and these Terms
We may modify, suspend or discontinue any part of the Site at any time without notice or liability. We may update these Terms from time to time by posting the updated version on this page and revising the "Last updated" date above, and we may provide additional notice of material changes. Updates take effect when posted unless we state otherwise. Your continued use of the Site after an update takes effect constitutes your acceptance of the updated Terms.
20. Suspension and termination
We may suspend or terminate your access to the Site, or to any account, at any time and for any reason, including a violation of these Terms. Provisions that by their nature should survive, including those on content you submit, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution and governing law, survive termination.
21. General
- Entire agreement. These Terms, our Privacy Policy and any service agreement or other written agreement with Unspoken are the entire agreement between you and us regarding the Site.
- Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign them without restriction, including in connection with a merger, acquisition or sale of assets.
- Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, public health emergencies, labor disputes, utility or internet failures and acts of government.
- Language. These Terms are written in English. Any translation is provided for convenience only, and the English version controls.
- Headings. Headings are for convenience only and do not affect interpretation.
