Consumer Health Data Privacy Policy
How we handle health-related information, such as a person's communication needs, under the Washington and Nevada consumer health data laws, and how to exercise your rights.
Effective date: October 12, 2026
Last updated: October 12, 2026
This Consumer Health Data Privacy Policy explains how Unspoken Language Services, Inc. ("Unspoken", "ULS", "we", "us" or "our") collects, uses, shares and protects consumer health data, as defined by the Washington My Health My Data Act and by Nevada law (NRS Chapter 603A), and how you can exercise your rights over it. It supplements our Privacy Policy, which applies to all other personal information.
What this policy covers
Consumer health data is personal information that is linked or reasonably linkable to a person and that identifies their past, present or future physical or mental health status. Because we arrange American Sign Language interpreting, information showing that a person is Deaf, DeafBlind or hard of hearing, has another disability that calls for interpreting, or has particular communication needs may be consumer health data.
This policy applies to consumer health data that a consumer, or their parent, legal guardian or authorized representative, gives us directly, for example through our Need an interpreter? page or a consumer profile. It does not apply to information we process on behalf of a client organization under a service agreement, such as details about a patient or student at an assignment the client arranges. We handle that information as the client's service provider or processor, under the client's instructions, and requests about it should be directed to that organization.
Consumer health data we collect, and why
- Communication needs and preferences, such as whether a person uses American Sign Language, signed English, tactile or ProTactile interpreting, or a Certified Deaf Interpreter team. We use this to identify and arrange a qualified interpreter.
- The fact that a person is Deaf, DeafBlind or hard of hearing, or has another disability that calls for interpreting, as shown by a request for help or a consumer profile. We use this to help the person obtain an interpreter and to arrange services.
- Appointment and event details, such as the type of organization (for example a doctor's office or hospital), the date, and a short description of the appointment or event. We use this to request and schedule an interpreter for that appointment.
- Accessibility notes on a consumer profile, such as seating or positioning needs for an interpreter. We use these so the interpreter can provide effective communication.
We do not ask for medical diagnoses, treatment information or medical records, and we ask you not to send them. We collect consumer health data only with your consent or as necessary to provide the help or services you request. We also use it to verify identity, age and authority, to keep records of consents and permissions, to secure our systems, and to meet legal obligations.
Where we get it
- The consumer, directly.
- The consumer's parent, legal guardian or authorized representative, or a family member or advocate helping an adult consumer with the consumer's permission.
- A client organization that links a consumer to its account or authorizes the consumer to request services on it.
- Our staff and interpreters, in the course of arranging and providing the services requested.
Consumer health data we share, and with whom
We share the consumer's name, contact details, communication needs and appointment details, and only with the following:
- The organization a consumer asks us to contact, only with the separate permission of the consumer or their parent, legal guardian or authorized representative, to ask that organization to provide an interpreter.
- Client organizations to which the consumer's profile is linked, for requests made on that client's account.
- Interpreters assigned to an appointment, limited to what they need to provide the service.
- Service providers that process data for us under contract and only on our instructions, in these categories: website and data hosting, email and text message delivery, and information security.
- Government authorities, where the law requires it.
We do not share consumer health data with any affiliate. We do not sell consumer health data, we do not use it for advertising, and we do not set up virtual boundaries (geofences) around health care facilities. Our Need an interpreter? page does not load analytics or advertising tools. Elsewhere, our website measures visits with Google Analytics only after you allow it in Cookie Preferences, and we never send what you enter in our forms to analytics or advertising services. We do not allow third parties to collect consumer health data about your online activities over time and across different websites.
Your rights
You have the right to:
- confirm whether we collect, share or sell your consumer health data;
- access your consumer health data, including a list of all third parties and affiliates with which we have shared it, with an active email address or other online contact for each;
- withdraw your consent to our collection or sharing of your consumer health data, including the permission to contact an organization;
- have your consumer health data deleted, including from our archives and backups, subject to the exceptions the law allows (deletion from backup systems may take up to six months); and
- review and ask us to correct your consumer health data.
How to make a request
Email contact@unspokenasl.com with "Consumer health data request" in the subject, or call 1-888-280-0751. We will verify your identity before responding, using information we already hold, and we may ask for more information for that purpose. A parent or legal guardian may make a request for a minor, and an authorized representative may make a request for an adult they represent, with proof of that authority. We respond within 45 days of receiving your request. If we need more time, we may extend that once by up to 45 more days and will tell you why within the first 45 days. We respond free of charge up to twice in any 12-month period. When you ask us to delete your consumer health data, we also notify the service providers and third parties with which we shared it.
How to appeal
If we decline to take action on your request, we will tell you why. You may appeal that decision by replying to our response, or by emailing contact@unspokenasl.com with "Consumer health data appeal" in the subject, within a reasonable time after you receive it. A member of our management team will review your appeal, and we will tell you in writing what action we took and why within 45 days of receiving it. If we deny your appeal, you may contact the Washington State Attorney General at www.atg.wa.gov/file-complaint, or the Nevada Attorney General at ag.nv.gov/Complaints.
Security and retention
We protect consumer health data with administrative, technical and physical safeguards. In a consumer's record, identity, contact details and notes are encrypted when we store them, access is limited to the staff who need it to do their work, and every view of a consumer's record is logged. We keep it only as long as needed for the purposes described in this policy, to meet legal obligations and to protect our rights, as described in the Data retention section of our Privacy Policy.
Changes to this policy
We may update this policy from time to time. We will post the updated policy here with a new "Last updated" date and, where the law requires, provide additional notice or ask for your consent before using consumer health data in a materially different way.
